1 About these terms

These Terms of Service apply to your use of the Alberta Cricket Store online retail website and purchases made through it. The seller is CRICKET STORE EDMONTON IMC, carrying on business as Alberta Cricket Store ("we", "us" or "our"). Our retail website is albertacricketstore.ca (the "Store").

Please read these Terms before placing an order. By placing an order, you agree to the Terms and the purchase conditions presented to you before checkout. Keep a copy of these Terms and your order confirmation for your records.

These Terms cover retail products and any product preparation or customization purchased with them. They do not govern indoor cricket lane bookings, coaching or facility use, which are subject to the terms presented for those services.

2 Your consumer rights

Nothing in these Terms excludes, restricts or waives any right, warranty, condition, remedy or protection that cannot lawfully be excluded under applicable law, including Alberta's Consumer Protection Act and Internet Sales Contract Regulation. Mandatory protections in your province, territory or other applicable jurisdiction also continue to apply.

If these Terms or another Store policy conflict with a mandatory legal protection, that protection prevails. Return restrictions, sale-item exclusions, customization conditions and warranty procedures do not remove remedies you have by law for defective, misdescribed, incorrectly supplied or undelivered goods.

3 Eligibility and account security

To place an order, you must have the legal capacity to enter into a binding contract and be authorized to use the payment method provided. If you are below the age of majority where you live, a parent or legal guardian must place the order on your behalf.

Provide accurate contact, billing and delivery information, and promptly tell us about any error that may affect your order. If you use an account, keep your login details confidential and notify us promptly if you suspect unauthorized access. You are responsible for activity you authorize; this does not make you automatically responsible for every unauthorized transaction.

4 Products and descriptions

We aim to describe our products accurately. Read the product description, size information, specifications and any preparation requirements before ordering. Contact us if you need clarification about a product or a particular use.

Photographs help illustrate products. Screen settings, packaging updates and natural differences in materials such as willow may affect appearance. These variations do not permit us to supply a materially different product or override a description, specification or representation that forms part of your purchase.

Stock levels and product listings may change. We may correct website errors, but will not change an agreed price or substitute a materially different item without your agreement. If an error or stock issue affects your order, we will contact you about available options and respect your rights under applicable law.

5 Prices and payment

The applicable currency, product prices, taxes, shipping charges and total amount payable to us are shown before you complete checkout. Review them carefully before submitting payment. Offers apply only on the conditions and during the period stated with the offer.

If international delivery is available for your order, additional import duties, taxes or brokerage charges may apply. Any such charges not collected by us, and who is responsible for them, must be disclosed in the applicable shipping information before purchase. Do not assume that every cross-border charge is included in the displayed product price.

Payments are processed through the payment services available at checkout. You authorize the amount shown for the order using your selected payment method. We will not add optional paid services or increase the agreed total without your consent.

6 Orders and cancellations

Check your selected items, quantities, customization instructions and delivery details before submitting an order. Your order confirmation records the transaction details. Please contact us promptly if you do not receive a confirmation or notice an error.

We may decline an order for a legitimate reason, such as unavailable stock, an unresolved material pricing error, suspected fraud or an unlawful transaction. If we cannot fulfil an order that has already been paid for, we will notify you and refund the amount paid for the cancelled portion, including any related charges that must be refunded by law. This does not limit any further remedy required by law.

If you wish to change or cancel an order, contact us promptly. The options available depend on the order's status, any agreed customization and the Return and Refund Policy disclosed before purchase. Statutory cancellation rights remain available regardless of these operational limits. Where a statutory cancellation applies, we will provide the required refund within the legally required period.

7 Delivery and collection

Available shipping destinations, delivery methods, charges and timing information are provided with the order and in our Shipping Policy. Any collection option is subject to the arrangements confirmed for your order. Wait for confirmation that an order is ready before collecting it.

Delivery estimates may be affected by circumstances outside our reasonable control. An estimate does not waive a contractual delivery commitment or any statutory cancellation or refund right. Contact us if your order is delayed, missing or arrives damaged so we can investigate and provide the remedy required by the purchase terms and applicable law.

Please provide a complete delivery address and tell us promptly about any correction. Any proposed additional charge arising from a requested change or failed delivery will be explained and agreed where required by law. We do not transfer all responsibility for delivery to you merely by handing a parcel to a carrier.

8 Returns refunds and product warranties

Our Return and Refund Policy, as presented before your purchase, sets out our voluntary return and exchange conditions, including any applicable deadlines, item exclusions, return-shipping responsibilities and disclosed fees. Please read it before ordering and contact us for return instructions before sending goods back. This request does not impose an additional condition on a statutory remedy.

For a damaged, defective, incorrect or misdescribed item, contact us with your order number and a description of the issue. Photographs and proof of purchase may help us assess it. We will explain the available remedy under applicable law and any additional warranty that applies. Do not send a return to an old address or directly to a manufacturer unless instructed to do so.

Any manufacturer's voluntary warranty applies according to its stated coverage and conditions, in addition to rights you have by law against the seller. These Terms do not create a universal warranty period for all products, and referring an issue to a manufacturer does not remove our own legal obligations.

9 Cricket equipment and customization

Follow the manufacturer's instructions for product selection, fitting, preparation, maintenance and safe use. Cricket bats may require preparation before play. Oiling, knocking-in, applying protective sheets, repairs and personalized items must be selected or otherwise agreed before we perform that work.

Any effect of authorized preparation or customization on voluntary cancellation or return eligibility must be disclosed before purchase. Preparation or use does not automatically remove rights relating to an existing defect or misdescription. We do not promise a particular playing performance or product lifespan unless it is expressly stated as part of the sale.

Protective equipment must be suitable for its intended use and correctly fitted. No sporting equipment eliminates every risk of injury. This is a safety reminder and does not release us from responsibility that cannot lawfully be excluded.

10 Acceptable use and intellectual property

Use the Store lawfully. Do not attempt unauthorized access, introduce malicious code, interfere with its operation, impersonate another person, submit fraudulent orders or infringe another person's rights.

The Store's original text, graphics, logos and other protected content belong to us or their respective owners or licensors. You may browse the Store and retain copies of your order records and policies for personal use. Other copying, resale or commercial exploitation requires the rights holder's permission, except where permitted by law. Third-party brands remain the property of their respective owners.

If the Store allows reviews, submit honest content based on your experience. Do not include unlawful, infringing or abusive material or another person's private information. Nothing in these Terms prevents you from posting an honest review or making a lawful complaint.

11 Shopify privacy and external services

Our Store uses Shopify's e-commerce platform. We are responsible for the products we sell, order fulfilment and customer service. Using Shopify does not make Shopify the seller of our products.

Our Privacy Policy explains how personal information is handled in connection with the Store. These Terms do not replace that policy or constitute blanket consent to unrelated marketing or data uses.

The Store may link to external websites or offer third-party payment or other services. Review the terms and privacy information applicable to a service you choose to use. We do not control unrelated third-party websites, but this does not exclude responsibility for our own conduct or obligations in your purchase.

12 Website availability and responsibility

We take reasonable steps to operate the Store but cannot promise that the website will always be uninterrupted or free from technical errors. We may temporarily restrict access for maintenance, security or other legitimate operational reasons.

To the extent permitted by applicable law, we do not give additional guarantees about uninterrupted access to the website or the suitability of general website information for every purpose. This statement does not disclaim product warranties, our express promises, or statutory rights and remedies.

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, or any liability that applicable law does not permit us to exclude or limit. We remain responsible for our obligations under your purchase contract and applicable law.

13 Suspension and changes to these terms

We may restrict an account or access to the Store where reasonably necessary to address unlawful activity, fraud, security risks or a material breach of these Terms. Any restriction does not cancel rights relating to an existing order, refund or valid warranty claim.

We may update these Terms by publishing a revised version with an updated date. Revisions apply prospectively and do not change an existing purchase without your agreement or another lawful basis. We will provide additional notice or obtain consent where required by law.

14 Governing law and resolving concerns

These Terms are governed by the laws of Alberta and the federal laws of Canada applicable there, subject to any mandatory consumer protections that apply to you. Nothing in these Terms requires mandatory arbitration, waives a lawful class proceeding, or prevents you from bringing a claim in a court or forum available to you under applicable law.

Please contact us if you have a concern so we can try to resolve it. Contacting us does not replace your right to seek legal remedies, raise a payment dispute or complain to a regulator. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision on one occasion is not a waiver of it.
